Section 78
<br> who can petition the court for the compulsory liquidation of a bank or financial institution
The National Bank may file an application in the court to initiate proceedings for the compulsory liquidation of any bank or financial institution in accordance with this paragraph and the notice of such application shall be published in a national level daily newspaper. The National Bank shall also attach the following documents to the application submitted to the court for initiation:- (a) Details of the conditions under section 79 for the compulsory liquidation of the bank or financial institution, including the reasons, and (b) the financial statement of the bank or financial institution. (3) ) Notwithstanding anything contained in sub-section (1), any of the following persons may, with the prior approval of the National Bank, file an application for cancellation before the court on the grounds that the bank or financial institution may be subject to compulsory liquidation in accordance with section 79:- (a) Payable deposit amount When demanding payment, representing more than twenty-five percent of the depositors who do not receive such payment, or a collective application of more than one percent of the depositors, or (b) a person capable of filing an application for compulsory cancellation in accordance with prevailing laws related to marriage. (4) According to sub-section (1) or (3). Based on the petition, if the court orders to start the process of liquidation of a bank or financial institution, the process of compulsory liquidation of the bank or financial institution will start from the date of such order.
